Terms of Service

"Platform" means the FlatCompute web application (flatcompute.com, app.flatcompute.com, admin.flatcompute.com), the REST API (api.flatcompute.com), and the inference gateway (gateway.flatcompute.com).

"Zone" means a GPU compute unit running a specific AI model. Zones have limited seats and may be in founding, active, full, or coming soon status.

"Plan" means a subscription tier (Starter, Builder, Pro, or Enterprise) within a Zone, defining RPM (requests per minute), concurrency, context window, and output token limits.

"Seat" means a subscription slot within a Zone. Each Zone has a maximum number of seats. We do not sell more seats than the Zone can handle — see our Fair Use Policy.

"Founding Seat" means a seat reserved during a Zone's founding phase, before the Zone is activated. Founding members receive 50% off for the first 3 months.

"API Key" means a LiteLLM virtual key issued via our backend, used to authenticate inference requests to the OpenAI-compatible API.

You must be at least 16 years old to use FlatCompute. If you are under 18, you represent that your legal guardian has reviewed and agreed to these Terms on your behalf.

You must provide a valid email address and a secure password. You are responsible for maintaining the security of your account credentials and for all activity under your account.

One person or entity may not hold more seats than permitted by our plan structure. Creating multiple accounts to circumvent rate limits or concurrency caps is prohibited.

Subscriptions are billed monthly in EUR (€) via Stripe. Payment is charged to the payment method associated with your account.

Active zones: Payment is charged immediately for the first month, and your API key is issued automatically. Subsequent months are billed on the same calendar day each month.

Founding seats: When you reserve a founding seat, we validate your payment method via a Stripe Setup Intent (€0 charge). No payment is taken until the Zone is activated. If the Zone does not reach its opening threshold within 30 days, your reservation is canceled and your card is not charged.

Founding discount: Founding members receive 50% off the plan price for the first 3 months. After 3 months, the standard price applies. The founding price is locked to your subscription for as long as you remain subscribed.

Taxes: Prices shown on the website exclude VAT or other applicable taxes. Where required by law, VAT will be added at checkout based on your billing country.

You can cancel your subscription at any time from the dashboard. Cancellation takes effect at the end of your current billing period — you retain access until then.

Founding reservations: You can cancel a founding reservation at any time before the Zone is activated, at no cost. If the Zone is activated and you are charged, the standard cancellation policy applies.

We do not offer refunds for partial billing periods. For details, see our Cancellation & Refund Policy.

Each Plan specifies RPM (requests per minute) and maximum concurrent requests. These limits are enforced by our LiteLLM gateway and cannot be overridden by the user.

Unlimited tokens: FlatCompute offers a flat-rate pricing model. You are not billed per token. However, "unlimited tokens" means unlimited volume within your plan's RPM and concurrency limits — not unlimited parallel capacity. See our Acceptable Use Policy for details.

API Keys: You may create and revoke API keys from the dashboard. Keys are tied to a specific subscription and Zone. You are responsible for keeping your keys secure. If a key is compromised, revoke it immediately from the dashboard.

Compatibility: Our API is OpenAI-compatible. However, not all OpenAI API features may be supported. We do not guarantee compatibility with every third-party library or tool.

You agree to use FlatCompute only for lawful purposes. You may not use the Platform to generate content that is illegal, harmful, or violates the rights of others. See our full Acceptable Use Policy.

You may not attempt to circumvent rate limits, concurrency caps, or seat limits. You may not share your API key with others outside your organization or resell access to your subscription.

FlatCompute provides inference services on a best-effort basis. We do not guarantee 100% uptime. GPU hardware can fail, and maintenance windows may be required.

No SLA during founding phase: Zones in founding or early activation phase may experience intermittent availability as we stabilize the infrastructure. We do not offer SLAs during this period.

Planned downtime: We will notify users at least 48 hours in advance of planned maintenance via email or dashboard announcement, except in emergencies.

Service changes: We may modify, suspend, or discontinue any Zone or model at any time. If a Zone is permanently discontinued, affected subscribers will receive a prorated refund for the unused portion of their billing period.

Your content: You retain ownership of the prompts you submit and the responses you receive. You are responsible for ensuring you have the rights to use any content you send to the Platform.

Model outputs: Outputs generated by AI models are not protected by copyright in all jurisdictions. You are responsible for reviewing and validating all outputs before use.

Model weights: The models served on FlatCompute are open-weights models (e.g., Qwen, DeepSeek) under their respective licenses. FlatCompute does not claim ownership of model weights. You should review the license of the specific model in your Zone.

Platform: The FlatCompute platform, including the website, dashboard, backend, and design system, is the property of FlatCompute. You may not copy, modify, or redistribute it.

We process personal data in accordance with the EU General Data Protection Regulation (GDPR). See our Privacy Policy for details on what data we collect, how we use it, and your rights.

Prompts and responses: We log usage data (tokens, latency, status codes) for billing, capacity planning, and abuse prevention. Prompt and response content is not stored long-term by default, but may be temporarily logged for debugging or abuse investigation.

FlatCompute is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that model outputs will be accurate, complete, or fit for any particular purpose.

AI models can produce incorrect, biased, or harmful outputs. You are solely responsible for evaluating and validating all outputs before using them in any context.

To the maximum extent permitted by law, FlatCompute shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising from your use of or inability to use the Platform.

Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid to FlatCompute in the 3 months preceding the claim.

This limitation does not apply to liability that cannot be excluded under applicable law (e.g., gross negligence, willful misconduct, or liability under EU consumer protection laws).

These Terms are governed by the laws of Spain. Any disputes arising from these Terms shall be resolved in the courts of Spain, unless mandatory consumer protection law in your jurisdiction requires otherwise.

Before initiating legal proceedings, we encourage both parties to attempt good-fa dispute resolution. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may update these Terms from time to time. We will notify users of material changes via email at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
